TERMS AND CONDITIONS of this STALLION SERVICE APPLICATION
1.   This mare is booked specifically by name. The booking is valid to the mare named and may not be transferred without consent of Seelster Farms Inc.
 
2. Mare owner(s) agree(s) that the mare named in this application shall be healthy and in sound breeding condition. Seelster Farms Inc. reserves the right to reject any mare not in good physical condition, or blind, or vicious and/or unmanageable. This mare must be registered with Standardbred Canada.
 
3. Neither Seelster Farms Inc, its owners, principals, employees, or agents shall be liable or responsible for any injury, disability or death suffered by any mare, or her offspring, from any cause whatsoever, while in the care, custody or control of Seelster Farms Inc. The undersigned owner/agent specifically agrees to this condition and hereby waives and releases all and every claim for damages resulting from such injury, disability or death.
 
4. The service fee shall be due when the mare produces a live foal (a foal that can stand up alone and nurse) or when the mare changes ownership, whichever occurs first. The Federal Harmonized Sales Tax (HST) (13%) will be applicable to service fees, boarding and veterinary charges, etc. and it will be added to all invoices. Seelster Farms Inc.'s H.S.T. number is R104773304. If the stud fee is not paid within 30 days of foaling, any discounts may be forfeited and the full stud fee plus a 1.5% monthly service charge will apply.
 
5. All accounts for board, veterinary fees, service fees (if due), overdue interest and expenditures made on behalf of the mare (and/or her foal) will be settled upon receipt of duly rendered invoices/statements and, in any event, before the mare is removed from the farm. A service charge of 18% per annum (1.5% per month) will be charged on all accounts unpaid after thirty days. Seelster Farms Inc. may refuse release of the mare(s) until all accounts are settled and no mating certificate for the foal will be released until the account is paid in full.
 
6. The mare(s) board rate will be charged at $18.00 per day. The foal(s) board rate will be charged at $4.00 per day. The breeding season commences on February 11, 2013 and closes July 5, 2013
 
7. The mare must have a NEGATIVE COGGINS TEST for equine infections anaemia dated no earlier than twenty-four (24) months prior to the date of her arrival at the farm. A certificate to this effect MUST ACCOMPANY THE MARE upon her arrival at the farm. Seelster Farms Inc. reserves the right to re-test the mare upon her arrival at the owners' expense.
 
8. Seelster Farms Inc. encourages mare owner(s) to have the mare's (and foal's) vaccinations and de-worming up-to-date prior to her (their) arrival at the farm. The owner(s) shall provide an up-to-date General Health record for the mare (and foal) on the Boarding Agreement returned with each approved Stallion Application. Seelster Farms Inc. reserves the right to vaccinate any mare with an incomplete or outdated vaccination history upon her arrival.
 
9. Semen transportation is available WITH PRIOR NOTIFICATION AND APPROVAL from Seelster Farms Inc. (Complete the box on the front of the application to apply.) Please note that a valid, active FedEx # and Credit Card are mandatory BEFORE booking semen shipments.
   
 10. If you require semen and you do not have a completed and approved Stallion Service Application signed and on file with Seelster Farms Inc there will be a $75.00 same day processing fee added to your mare’s invoice. Please ensure ALL documents are signed and on file with Seelster Farms Inc prior to ordering semen.
   
11. In all cases where semen transport is requested, the person performing the artificial insemination assumes FULL responsibility for the identification of the mare being bred. Seelster Farms Inc shall NOT be liable for and is released from claims arising by reason of the mare not having a live foal or becoming infected, diseased or injured as a result of such breeding.
   
12. If one owner signs this agreement, when there are multiple owners, the terms and conditions of this agreement will bind all owners. If this agreement is signed by an agent for the owner(s), then the agent and all owners will be bound by the terms and conditions of this agreement.
   
13. If any horse is sold or transferred between owners while being bred to any stallions at Seelster Farms Inc, the original owner(s) must notify Seelster Farms Inc of the change in writing, within 10 days of the date of change of ownership. If there is any change in ownership or lease, and Seelster Farms Inc is not notified of the change, the original owner(s) will be held for all the charges of the mare while she is being bred to any stallion at Seelster Farms Inc.
